AN ORDINANCE VACATING CERTAIN EASEMENTS AND RIGHTS-OF-WAYS OF THE BRUNSWICK PARK SUBDIVISION SECTIONS I, II AND III
WHEREAS, the Indiana General Assembly has authorized the Town of Plainfield to vacate all or any part of a public way or public place within its municipal boundaries and;
WHEREAS, Duke Construction, LP and Becton Dickinson and Company have petitioned the Town of Plainfield to vacate certain easements and rights-of-way of the Brunswick Park Subdivision, Sections I, II and III located within the Town of Plainfield’s municipal boundaries and;
WHEREAS, notice of publication has been given as prescribed by l. C. 5-3-1, and the proof of publication having been filed with the Clerk-Treasurer of the Town of Plainfield of Hendricks County, Indiana; and
WHEREAS, the members of the Town Council of the Town of Plainfield of Hendricks County, Indiana, having held a public hearing to vacate certain easements and rights-of-way of the Brunswick Park Subdivision Sections I, II and III on
July 11, 2005 at 7:30 p.m.; and
WHRERAS, after reviewing all of the pertinent facts relative to vacation of certain easements and rights-of-ways of Brunswick Park Subdivision Sections I, II and III, and all interested persons having had an opportunity to be heard at the public hearing,
BE IT ORDAINED by the Town Council of the Town of Plainfield, Hendricks County, Indiana that:
That the following easements and rights-of-way of Brunswick Park Sections I, II and III heretofore platted are hereby VACATED which easements and rights-of-ways are more particularly described in Exhibit A attached hereto.
This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
PASSED AND ADOPTED this 8th day of August 2005.

Description of Easements & Rights-of-Way to be Vacated Brunswick Park Subdivision, Sections I, II and III
All of the platted right-of-ways for Reeves Road, Bradley Drive, Brunswick Drive, Bart Road, Brent Drive, Adzy Drive, Joshua Court and Jason Court, and all of the platted drainage easements, utility easements and common area located within the Brunswick Park Section I Addition recorded as Plat Book 8, Page 54, the Brunswick Park Section II Addition recorded as Plat Book 8, Page 90 and the Brunswick Park Section III Addition recorded within Plat Cabinet 4, Slide 75, Page 2 (Instrument Number 9700004698), all being a part of the Northeast Quarter of Section 1, Township 14 North, Range 1 East and the Northwest Quarter of Section 6, Township 14 North, Range 2 East, Hendricks County, the perimeter boundary of which may be more particularly described as follows:
