AN ORDINANCE CONCERNING THE TRACKING OF DIRT, MUD AND DEBRIS ON TOWN STREETS AND REPEALING ORDINANCE NO. 08-2005
WHEREAS, the Town of Plainfield has adopted General Ordinance No. 08-2005 titled AN ORDINANCE CONCERNING THE TRACKING OF DIRT, MUD AND DEBRIS ON TOWN STREETS AND REPEALING ALL ORDINAINCES IN CONFLICT HEREWITH,
WHEREAS, it has now been determined to be in the best interest of the Town of Plainfield to repeal said Ordinance No. 08-2005,
WHEREAS, the Plainfield Town Council and Plainfield Street Department are responsible for the maintenance of certain streets within the Town of Plainfield, Indiana (“the Streets”); and
WHEREAS, the tracking, dropping and depositing of mud and other debris from vehicles on the Streets may create a health and safety hazard upon the Streets; and,
WHEREAS, it is in the best interests of the health, safety and welfare of the citizens of Plainfield that an ordinance be passed prohibiting the tracking or dropping of mud, dirt or other debris on the Streets maintained by the Plainfield Street Department.
BE IT ORDAINED by the Town Council of the Town of Plainfield, Hendricks County, Indiana, that:
SECTION 1:
(a) Operates a motor vehicle on a road maintained by the Plainfield Street Department which drops or tracks mud, dirt or debris on a Street maintained by the Plainfield Street Department; or
(b) Owns, or directs the operation of a vehicle which drops or tracks mud, dirt or debris on a Street maintained by the Plainfield Street Department; or
(c) Owns real estate from which a vehicle drops or tracks mud, dirt or debris on a Street maintained by the Plainfield Street Department shall be subject to a fine of not less than Twenty Five Dollars ($25.00) and no more than One Hundred Dollars ($100.00) for each offense.
SECTION 2:
Any officer of the Plainfield Metropolitan Police Department, Plainfield Police Community Service Officers, Town Engineer, Superintendent of Public Works, Town Manager or any other agents authorized by the Plainfield Town Council may, in the name of the Town of Plainfield, file and pursue actions in the Plainfield Town Court of the Town of Plainfield, Indiana or any other court of competent jurisdiction against a person or corporation who commits an act in violation of this Ordinance.
This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
SECTION 3:
Ordinance No 18-99 titled Ordinance Concerning the Tracking of Dirt, Mud and Debris on Town Streets, and passed and adopted on August 9, 1999, and any other ordinance in conflict herewith is repealed by the adoption of this Ordinance, said repeal to become effective on the day that this Ordinance becomes effective. The repeal of any prior Ordinance or provision of a prior Ordinance by this Ordinance shall not have any effect on existing litigation and shall not act as an abatement of any actions or proceedings pending under or by virtue of the repealed Ordinance or provision upon this adoption of this Ordinance.
This Ordinance shall be in full force and effect from and after its passage and any publication required by law.
SAID ORDINANCE is hereby passed and adopted this 27th day of June 2005.
