TOWN OF PLAINFIELD
BOARD OF ZONING APPEALS


June 15, 2009

The Plainfield Board of Zoning Appeals met on Monday, June 15, 2009. In attendance were Ms. Duffer, Mr. Cavanaugh, Mr. Gibbs and Mr. Monnett.

The minutes of the April 20, 2009 Board of Zoning Appeals were approved as submitted.

OATH OF TESTIMONY

PUBLIC HEARINGS

(Minutes began at this point and time).

Mr. Eric Morff at 50 Crestwood, Executive Center suite 500, St. Louis, MO 63126 said I'm here on behalf of Hardee's Food Systems this evening. You did a very good job making our presentation. That is exactly the points that we wanted to get across and just basically wanted to let you know that we are here to answer any questions. I have Don Campbell here with me from Hardee's as well so we can answer any questions that you might have. As she stated, the main point is to help improve the traffic flow through the site. The sign is going to be in the back where it won't be visible for any public right-of-ways. It is just going to be there for the customer's use and we hope to speed the service level and reduce the amount of traffic flow on the site so that the customers can see their choices before they get to the menu board. If you have any questions, just let us know.

Mr. Monnett asked, are you planning on demolishing that current location, is that correct?

Mr. Morff said that is correct.

Mr. Monnett asked, how soon is that?

(Inaudible).

Mr. Monnett said I'm sure those are standard sizes and everything so how long does it usually take to put those up barring the weather?

(Inaudible).

Mr. Monnett asked, whoever owns that building and land, do you guys own the land?

(Inaudible).

Mr. Monnett asked, what about to the north there?

(Inaudible).

Mr. Monnett said the grass? That is theirs, okay. You can expand into that?

(Inaudible). The footprint of that will actually be smaller (inaudible).

Mr. Monnett asked, how long has that current building been there?

(Inaudible).

Mr. Carlucci said several years ago they could put a (inaudible).

(Inaudible).

Mr. Carlucci said the only reason I mention this is (inaudible). (Inaudible) owns the building to the west. He pointed out, it doesn't make any difference to me, that there was an agreement (inaudible) he was very upset (inaudible). He never did do anything about it so if you don't do anything about it after (inaudible). (Inaudible) what your setbacks were (inaudible).

Mr. Monnett said if you would please come up and give your name and address for the record. That way we can hear you and keep it recorded.

Mr. Don Campbell with Hardee's Food Systems said I'm in the Hardee's office in Rocky Mountain, North Carolina at 321 Jefferies Road, Rocky Mountain, North Carolina. If you will notice, on this area right here right now the front of the building is a little farther up here and that concrete area where the playground is at is here. What we propose is to open up a drive-thru area here and increase the size of the green area in front and that would actually push the building back a little bit away from the street, which should answer all of those questions that anybody should have.

Mr. Carlucci said it doesn't matter to me really. I just remember how upset he seemed at the time.

Mr. Campbell said I assure you that Mr. James has checked and made sure that we were within the codes.

Mr. Cavanaugh said I presume that the proposed sign is in a similar size to what is there now.

Mr. Campbell said the menu boards?

Mr. Monnett said the presale.

Mr. Campbell said the presale board and the menu board that are there today the ones that we will put back are exactly the same size. I would reuse those except that the car ran over the pre-menu board about three weeks ago or four weeks ago and we had to kind of patch it up. The menu board somehow or the other the doors on the back of it has been damaged and doesn't close very well. But they will be exactly the same pre-reader board or menu board that we propose to put back.

Mr. Monnett asked, will it be the same color?

Mr. Campbell said the color now is grey. When we put it back, it will be black to be in tune with out color scheme.

Mr. Carlucci said there is a well established Meijer's table there.

Mr. Campbell said yes sir I know all about that table.

Mr. Carlucci said you might have to adopt them out to another franchise.

Mr. Campbell said we might be in a little trouble there because the dining room is going to be quite a bit smaller and I'm sure we are going to have some conversation about that when we build this new restaurant.

Mr. James said this is the office just behind it and the dentist office back here so there is existing buildings up in the block. Plus you have a nice setback here with all of the green space and residential to the north. The development plan for the new Hardee's will be heard by the Plan Commission at the July 6th meeting.

Mr. Monnett said I will close the public portion and open it up to the board for anymore discussions or a possible motion.

Mr. Gibbs made a motion that the Board of Zoning Appeals approve BZA-09-004 as filed by Hardee's Food Systems, Inc. requesting a Variance to the Development Standards of the Sign Regulations to allow a pre-menu board for the drive-thru at a newly constructed Hardee's at 1630 E. Main Street subject to the following:

1. Substantial compliance with the site plan and sign specifications file dated May 15, 2009.
2. Prior to installation of any signs an Improvement Location Permit (ILP) is required.

Second by Ms. Duffer. Roll call vote called.

  • Ms. Duffer – yes
  • Mr. Cavanaugh – yes
  • Mr. Gibbs – yes
  • Mr. Monnett – yes

4-ayes, 0-opposed, 0-absent. Motion carried.

OLD BUSINESS/NEW BUSINESS

None.

Ms. Duffer made a motion to adjourn. Second by Mr. Gibbs. Motion carried.
