PLAINFIELD BOARD OF ZONING APPEALS AGENDA
For February 18, 2010, 7:00PM

CALL TO ORDER


Mr. Monnett: I would like to call to order the Plainfield Board of Zoning Appeals meeting for February 18, 2010. I will now ask our Board Secretary to if he will do our roll call for determination of a quorum.

We have three members present, one absent; we have a quorum for the purpose of conducting business.
PLEDGE OF ALLEGIANCE

Mr. Monnett: Would you please rise for the Pledge of Allegiance.

APPROVAL OF MINUTES (December 21, 2009 meeting)

Mr. Monnett: I will now entertain a motion for approval or amendments to our minutes from our meeting from December 21, 2009.

Ms. Duffer: I make the motion to approve the minutes.

Mr. Monnett: I have a motion. And I will second it. All in favor say aye.

Mr. Cavanaugh: Mr. Chairman, I would like the record to show that I (inaudible) not voting, as I was not present that meeting.

Mr. Carlucci: Therefore you cannot approve the minutes today.

ELECTION OF OFFICERS

Mr. Monnett: Our next business is election of officers for 2010 for our Board.

Mr. Carlucci: You're the President, who is the Vice President?

Ms. Duffer: Me.

Mr. Carlucci: Katherine, ok. As the Board Secretary, is there a motion to…?

Mr. Cavanaugh: I was here.

Mr. Monnett: That's what I thought; I looked on the second page and…

Ms. Duffer: So we are going to further the minutes?

Mr. Carlucci: Yeah, with a change. That he was not absent.

Mr. Monnett: I kept reading through there Mr. Cavanaugh.

Mr. Cavanaugh: I knew it didn't quite feel right, I will vote to approve the minutes as written.

Mr. Monnett: Thank you Mr. Cavanaugh.

Mr. Carlucci: Is there a second?

Ms. Duffer: Second.

Mr. Monnett: The motion is second, all those in favor say aye, thank you.

Mr. Carlucci: Motion was made by Mr. Cavanaugh, second by Ms. Duffer.

Mr. Monnett: Now back to Election of Officers.

Mr. Carlucci: What you could do, it's a desire to maintain the existing leadership of Mr. Monnett as Board President and Ms. Duffer as Vice President.

Mr. Cavanaugh: So move.

Ms. Duffer: Second.

Mr. Carlucci: A motion was made by Mr. Cavanaugh, and Ms. Duffer. All those in favor say aye, Motion carries. Elections are over.

OATH OF TESTIMONY

Mr. Monnett: I will now ask our Board Secretary if he will administer the Oath of Testimony to those of you that are going before the Board tonight.

Mr. Carlucci: Conducted the Oath of Testimony.

PUBLIC HEARINGS

Mr. Monnett: Conducted the Guidelines Governing the Conduct of Public Hearings.

PETITIONS FOR PUBLIC HEARING

Mr. Monnett: Tonight is, BZA-10-001 Town of Plainfield, 986 S. Center Street., requests a special exception to allow the expansion of the existing Department of Public Works maintenance garage facility in the R-1 Low Density Residential District.

Mr. Carlucci: Please speak clearly and louder, thank you.

Ms. Sprague: This one is for the DPW maintenance garage at 986 S. Center Street. It's zoned R-1 and the R-1 district requires a special exception for any expansions to the facility. That is why we are here tonight and also that is part of the fade instead of doing the gateway quarter information they are bond you would quarter and those only apply to those commercial and industrial districts. It's zoned R-1, and it's primarily surrounded by residential and a little bit of park around there. But the nearest residential is actually only to the north, to the south is more of the Correctional Facility rather than the actual residential. They are requesting to add the 4,000 square foot expansion to the existing maintenance garage and they are going to move some parking that will be taken up by the expansion itself and for the work area to build the expansion. I believe that is planning for the area of use of the outdoor storage (inaudible) map of that land. There's a little bit of landscaping that will be removed by the parking but otherwise they have some really well landscaping around it and I can show you a photo of that. So the red square there is where the expansion will be and then over here in the yellow is where I believe the parking is going to be moved too. So they will still have enough. There is lots of perimeter landscaping along Center Street that will help screen (inaudible). This is what the expansion will look like; it was designed to match the materials to build. Then that is a photo that I took along with the other; the expansion will be behind the trees as you can't see that but it will be there where the existing buildings (inaudible) it is consistent with the comp plan which has institutional uses and then the proposed (inaudible) consistent with the existing building the landscaping and parking are going to be covered by either what is already there or where they are moving parking too. And then just a side note, we are proposing a municipal district so that they will be able to do a master plan instead of having to come before the Board of Zoning Appeals every time they do an expansion or a parking transition or something. Hopefully they can do that the one time and then we will be able to approve the rest by items (inaudible).

Ms. Duffer: When do you anticipate that being done with the master plan?

Ms. Sprague: Well, It's going to go to the Plan Commission but both ordinances are going to go to the Plan Commission this next meeting.

Mr. Monnett: Is the size the same or is it going to be smaller? I mean what was proposed, you're not asking for what Tim wrote but I don't know if that is a budgetary.

Ms. Sprague: The existing building is up here and (inaudible).
Mr. Monnett: Right.

Mr. J. Castetter: (inaudible)

Mr. Carlucci: Jason, please give your name and address.

Mr. J. Castetter: Jason Castetter, 9 Wedding Lane, Plainfield. The existing building is 1,800 square feet. (Inaudible)

Mr. Monnett: So, it's 50X80 or roughly.

Mr. J. Castetter: Yes sir.

Mr. Monnett: Is that still on or is that…? Do sewer guys use that too or is it just you guys? I can't remember. Oh, they got their own little…

Mr. J. Castetter: (inaudible) facility involves all departments, water, sewer, storm and things like that.

Mr. Carlucci: Jill did you have anything more to add?

Mr. Belcher: My name is Tim Belcher, 723 S. East Street, here in Plainfield. Thanks for hearing our case tonight; I am just here to help Jason facilitate this project. I really appreciate what Jill has (inaudible) presentation better than I could do, but I (inaudible) just a couple of things to go with that master plan (inaudible). This is the entire area down there that the(inaudible) this plan will probably change as we go to the Plan Commission but you can see this big pond standing there by the (inaudible) get rid of that and we will be getting that land back to use by facilities. The red boxes that Jill showed you is the same boxes you see there. 4,000 foot expansion for now and maybe in the future there will be another one. (Inaudible) as it will allow and in the future. A lot of things going on with parking too, I don't want to misrepresent anything here but there is potential, if you can see right here how they laid out some parking that might take a few of those trees out, probably in that little area here the ones in the picture will still be there if that happens, again right the initial phase is that we would park over here, I think that was the area that was out (inaudible) storage, these spaces here that go away which would be right by the garage door now (inaudible) so you won't lose any parking with this phase. It's a long term use of what we hope to do down there and fix the parking here and move this building over here. Those are the kind of things that we're going to come back to the Plan Commission if they go through the district, we'll come back and meet with you (inaudible). I got another renovation on the building but on black and white (inaudible).

Mr. Monnett: So it's three doors then? Three garage doors?

Mr. Belcher: Yeah, this would be the existing (inaudible) over here by the entry now it's going to get (inaudible) new expansion on the back so there is our new (inaudible), just got (inaudible) Center Street. (Inaudible) Jill showed it in her report (inaudible) she covered that. Essentially that's our project and I know down at Jason's shop we were lucky with the snowfall he has got trucks and piles everywhere so he does need the space and would appreciate your approval on the project. Thanks.

Mr. Monnett: Thank you, Mr. Castetter, Mr. Belcher, and Jill. Anyone else? Seeing there is no one else in the audience I'll close this and open it up to our Board for any discussions or a possible motion.

Mr. Cavanaugh: I really don't have any questions I think it is reasonable request and I move that the Board of Zoning Appeals approve BZA-10-001 as filed by the Town of Plainfield, requesting a special exception to allow 4,000 square foot expansion to the existing DPW maintenance garage subject to the following conditions. No. 1, substantial compliance with the site plan, landscaping plan, and elevation plan filed on January 27, 2010.

Ms. Duffer: I'll second.

Mr. Monnett: I have a motion and second. Mr. Carlucci, would you please poll the board?

Old Business/ New Business

Mr. Monnett: Old business, new business, Mr. James?

Mr. James: I've just got one item. This is a proposed amendment to the Zoning Ordinance (inaudible) Article 7.4 of Plainfield Zoning Ordinance in regards to signs allowed on the wall sides in a Façade Plane with (inaudible) all sides of architectural (inaudible) irrigation regarding all sides architectural features like a tower for a gable so we think that this amendment will fix a problem with high voltage creates with the (inaudible) on all sides of the architectural features and just wanted to let you know that we have come up with a solution to this problem.

Ms. Duffer: I think this is a good solution.

Mr. James: This will go to the Plan Commission March 1st. With that, we had two other amendments (inaudible) district, and one is an amendment to the DRC and the DRC rules.

Mr. Cavanaugh: Do you have to go through the (inaudible) talk about the tenant for the Façade Plane, does that pertain to an area where a lot of (inaudible) where they have a more area inside there or they think they might (inaudible) from the architectural detail in the building, is that give people a way to either expand or reduce their signage if they are occupying or is that usually petitioned part of the building?

Mr. James: That building has one Façade Plane, so (inaudible) in there too, ten percent of the tenant space.

Mr. Cavanaugh: (inaudible) this doesn't change that (inaudible).

Mr. James: If there are no more questions, that concludes tonight's business.

Mr. Monnett: Thank you.

Mr. Carlucci: I'd like to add just one more thing, I had and no particular reason behind this, I had Joe go back and look at the last 24 months at what the BZA has done and when we get a couple things changed in it. But I think I find that interesting to see what's gone on in the last two years and see what the issues that have come up and actually because of what happened at the BZA some of these things were changed within the Plan Commission so we will have that for you at the next meeting. If it's available sooner which it will be, we'll just send email it to you all. Joe did a good job with that, I just haven't had time to get back to him to discuss a couple of things and get it in the final form. Quite honestly, the things that we need to have are the two things that have been rejected, very few. And some of the things that we're rejected that actually changes came from that and in the Zoning Ordinance and we couldn't do then, that you can do now. But I think it will give you a good idea of what at least what you have been doing the last two years and you can kind of see a trend in some of these things, and then things got changed with. I thought it was pretty interesting when I looked through it; it's something that you don't, and you're (inaudible) timeline because you don't see it all the time. That's all I have.
