AN ORDINANCE TO AMEND ORDINANCE NO. 7-2001
ALSO KNOWN AS AN ORDINANCE ESTABLISHING RATES
AND CHARGES FOR THE USE AND SERVICES RENDERED
BY THE WATERWORKS SYSTEM OF THE
TOWN OF PLAINFIELD, INDIANA
BE IT ORDAINED by the Town Council of the Town of Plainfield, Hendricks County, Indiana, that:
WHEREAS, the Town Council of the Town of Plainfield, Hendricks County, Indiana, deems it appropriate to amend Ordinance No. 7-2001 to establish a summer sewer rate to provide relief for single-family residential customers that sprinkle their lawns: and
WHEREAS, the Town Council of the Town of Plainfield, Hendricks County, Indiana, has the authority under I.C.8-1.53 (and amendments thereto) to establish waterworks user fees and charges.
NOW THEREFORE by the powers vested in the Town Council of the Town of Plainfield, Hendricks County, Indiana, it is hereby ORDERED AND ORDAINED that:
Section 1. Single-family residential customers shall be eligible for summer sewer rate relief. Single-family residential sewage service, as applicable to the sprinkling rate, shall apply to each lot, parcel or real estate or building which is used as a single-family residence. Said sprinkling rates shall not apply to any premises used wholly or in part as commercial, industrial or multi-family (two units or more).
Section 2. The summer value will be the residential unmetered sewer flat rate per month.
Section 3. The summer sewer rate will begin with the June billing and end with the October billing.
Section 4. For summer sewer rates, single-family residential customers shall be required to execute a Summer Sewer Rate Agreement (Executed Agreement) and pay a $50.00 non-refundable application fee at the Plainfield Town Hall, 206 W. Main Street, Plainfield. Deadline is May 20. Customers will be allowed to apply until September. After the May 20 deadline a $10.00 penalty will be added to the $50.00 application fee. Summer sewer rates commence with the completion of the application and payment of the application fee and the payment of any additional penalty due to missing the May 20 deadline. Summer sewer rates are not retroactive to a date earlier than the date of the Executed Agreement.
Section 5. The summer sewer rate shall remain in effect until rescinded by the customer in writing, to the Town of Plainfield Town Hall, P.O. Box 65, Plainfield, Indiana.
Section 6. The invalidity of any section, clauses, sentence or provision of the Ordinance shall not affect the validity of any part of this Ordinance which can be given effect without such invalid part or parts
This Ordinance shall be in full force and effect from and after its passage and adoption by law.
THIS ORDINANCE is hereby passed and adopted by the Town Council of the Town of Plainfield, Indiana, on the 29th day of May, 2012
