RESOLUTION NO. 2003-07
A RESOLUTION OF THE PLAINFIELD TOWN COUNCIL TO ADOPT THE WRITTEN FISCAL PLAN OF AN AREA ON THE NORTHWEST SIDE OF PLAINFIELD, INDIANA, PIKE LANE ANNEXATION AREA ORDINANCE NO. 04-2003
WHEREAS, in conjunction with I.C. 36-4-13-3, written fiscal plan has been prepared by the Town of Plainfield for annexation of an area on the northwest side of Plainfield, more particularly described in Plainfield Town Council Ordinance No. 04-2003; and
WHEREAS, responsible planning and state law require adoption of a fiscal plan and a definite policy for provision of services to annexed areas; and
WHEREAS, such a plan has been developed and presented to the Town Council entitled "Annexation Study for Land Contiguous to the Town of Plainfield, Indiana, Pike Lane Annexation Area submitted to the Town of Plainfield on February 24, 2003."
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PLAINFIELD, INDIANA, THAT:
Section 1. The Plainfield Town Council adopts and approves the written fiscal plan entitled "Annexation Study for land Contiguous to the Town of Plainfield, Indiana, Pike Lane Annexation Area submitted to the Town of Plainfield on February 24, 2003," attached hereto and made a part hereof, as the written fiscal plan of the area to be annexed on the north side of Plainfield, more particularly described in Plainfield Town Council Ordinance No. 04-2003, and hereby approves and adopts the specific policies for implementation of the Plan as set out therein.
Section 2. Any monies necessary for the provision of services as described and itemized in the attached Plan shall be budgeted and appropriated from the applicable fund, pursuant to State law and the Town's budget procedure.
Section 3. It is anticipated that this annexation will not result in the elimination of jobs for employees or other governmental entities, but in the event it does, then the Town Manager of the Town of Plainfield is hereby directed to assist such employees in obtaining new employment, but nothing shall require the Town to hire any such employees.
Section 4. The sections, paragraphs, sentences, clauses, and phrases of this resolution are separable, and if any sections, paragraphs, sentences, clauses and phrases of this Resolution shall be declared unconstitutional, invalid or unenforceable by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality, invalidity or unenforceability shall not affect any of the remaining sections, paragraphs, sentences, clause and phrases of this Resolution.
Section 5. This resolution shall be in full force and effect from and after its passage by the Town Council, Town of Plainfield, Hendricks County, Indiana.
Passed by the Town Council of the Town of Plainfield, this 24th day of February 2003.
