RESOLUTION APPOINTING AUTHORIZED AGENT TO
HANDLE CONSTRUCTION DISPUTES
WHEREAS, the Town of Plainfield, Indiana, is a municipal corporation and is limited as to who is authorized to make a binding agreement on behalf of the Town;
WHEREAS, the Town is a party to a contract for construction of Fire Station 123 for the Plainfield Fire Territory;
WHEREAS, certain disputes have arisen between the Owner (Plainfield) and the Contractor and some of the sub-contractors;
WHEREAS, the Town desires to authorize Robin G. Brandgard, President of the Plainfield Town Council, as its authorized agent with the authority to negotiate, mediate, file or defend litigation and enter into a binding settlement agreement on behalf of the Town of Plainfield with the Contractor and any sub-contractors;
WHEREAS, the Town Council for the Town of Plainfield, Indiana, will bestow upon Robin G. Brandgard certain parameters within which he may settle the disputes, including giving him certain monetary and other authority (which is not to be shared with anyone other than counsel for the Town) necessary to negotiate, mediate and/or settle the disputes on behalf of the Town of Plainfield;
NOW, THEREFORE, BE IT RESOLVED that Robin G. Brandgard, as President of the Plainfield Town Council, is hereby authorized by the Town Council to participate on behalf of the Town in the negotiation, mediation or filing or defending litigation on behalf of the Town; and, if a settlement is reached as the result of such mediation or negotiation or otherwise to execute a binding settlement agreement on behalf of the Town of Plainfield to settle the disputes.
