AN ORDINANCE VACATING ALLEYWAYS
AND RESERVING UTILITY EASEMENTS
BE IT ORDAINED by the Town of Plainfield, Hendricks County, Indiana, that:
WHEREAS, the Town Council of the Town of Plainfield, Hendricks County, Indiana initiated proceedings to vacate alleyways, pursuant to statute; and
WHEREAS, notice of publication has been given as prescribed by l. C. 5-3-1, and the proof of publication having been filed with the Clerk-Treasurer of the Town of Plainfield of Hendricks County, Indiana; and
WHEREAS, the members of the Town Council of the Town of Plainfield of Hendricks County, Indiana, having held a public hearing to vacate alleyways on
July 28, 2003 at 7:30 p.m.; and
WHRERAS, after reviewing all of the pertinent facts relative to vacation of alleyways and all interested persons having had an opportunity to be heard at the public hearing;
NOW, THEREFORE, by the powers vested in the Town Council of the Town of Plainfield of Hendricks County, Indiana, pursuant to l. C. 36-7-3-12 is hereby ordered and ordained that alleyways be vacated.
A fifteen (15) foot alley in Block Numbered Seven (7) in the Original
Town of Plainfield, Hendricks County, Indiana, as per plat thereof
Recorded July 17, 1832, in Deed Record 2, Page 225, in the Office of
Recorder of Hendricks County, Indiana, said alley being bound on the
North by Lots 1 and 2, and on the South by Lot 8, on the west by the
west line of Lots 2 and 8 and on the east by the east line of Lots 1 and 8.
And that title to the above-described Alley shall revert one-half each, being seven and one-half (7 ½) feet to the titleholders of Lots 1, 2, and 8 Block Numbered 7 in the Original Town of Plainfield, Hendricks County, Indiana, so that the south lot lines of Lots 1 and 2 shall be extended to the centerline of the alleyway and the north lot line of Lot 8 shall be extended to the centerline of said alleyway; and that a public utility easement shall be reserved to the Town of Plainfield over and across the entire vacated alleyway.
This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
