PLAINFIELD TOWN COUNCIL
November 28, 2011

Mr. Brandgard: Plainfield Town Council meeting for Monday, November 28, 2011 is now in session.
PLEDGE OF ALLEGIANCE

Mr. Brandgard: I understand we have a couple of Boy Scouts from troop 308 at Hope Presbyterian, we start our meetings with the Pledge of Allegiance and I would appreciate if you guys could come up and lead us in the pledge. Thank you, and thank you for coming out tonight, as I like to tell the younger folks that you are welcome to stay for the meeting as long as you like if you reach a time that you have to leave there is no problem with getting up and leaving, we appreciate you being here, thank you.

CONSENT AGENDA

Mr. Brandgard: We do have one member absent this evening, Kent McPhail, but we do have a quorum for doing business. On the consent agenda we have eight items.

1. Approval of minutes of the regularly scheduled Town Council meeting of Monday, November 14, 2011.
2. Approval of Plainfield Fire Chief's report dated November 22, 2011, Town Engineer's report dated November 23, 2011, Transportation Director's report dated November 25, 2011, and HR Director's.
3. Approval of a professional services contract with Butler, Fairman and Seufert in an amount not to exceed $23,700 for three years of stream mitigation monitoring and reporting per the Town Engineer's report dated November 23, 2011.
4. Approval of a professional services contract with Butler, Fairman and Seufert in an amount not to exceed $62,000 for the Hardin's Court ditch area drainage study per the Town Engineer's report dated November 23, 2011.
5. Approval of October 2011 monthly report for the Plainfield Town Court.
6. Approval of Change Order #021 for installation of a sound system in the training room per Addendum #2 in the amount of $2,295.00 per Chief Anderson's report dated November 22, 2011.
7. Approval of Change Order #022 for retaining the existing temporary electrical service equipment in the amount of $880.00 per Chief Anderson's report dated November 22, 2011.

Mr. Brandgard: Are there any changes or amendments to the consent agenda?

Mr. Kirchoff: I have about three things, on the minutes, I wouldn't normally worry about this one since I am going to make a couple of changes, I will make this one a suggestion as well, on page 10 we were talking the resolution for mass transit, CIRTA is C-I-R-T-A, Central Indiana Regional Transit Authority instead of C-E-R-T-A, and on page 20 and 21 in my conversation concerning the Economic Development, Hendricks County Development Partnership, there is three or four references to c-i-r-c-l-u-s which I think is supposed to be surplus.

Mr. Bennett: We have made except for the first one mentioned on page 10 we have made the surplus corrections, you got an unedited and unrevised copy but we will make that correction on page 10.

Mr. Kirchoff: Then I had a couple of questions on a couple of other items, on item 3, I guess I would ask Tim, do we not have anybody on our staff that would have the expertise, the reason I am asking, with economic downturn, I'm sure work loads are not as heavy in a couple of departments and I just wonder if we had anybody on staff that have the expertise that could do that and time.

Mr. Belcher: Actually yes on the second account, and no on the first. We probably have some time, but the expertise that it requires in terms of monitoring those, what it comes down to is the permit that we were issued has a tremendous amount of planning materials that have to be a certain species, and what we are really tracking or are required to track is I guess the success rate of those species over a certain number of areas, so even recognizing those species is, I suppose we can get trained, but we don't have anybody at this time.

Mr. Kirchoff: That answers that one, and then typically we don't get in details on change orders but I was curious, I assume we have documentation for the item number 8.

Mr. Daniel: We do have.

Mr. Kirchoff: With that being said I would move that we approve the consent agenda as amended.

BUSINESS FROM THE FLOOR

Mr. Brandgard: Business from the floor, is Kim Harvey in the audience, from Angels and Doves?

Ms. Harvey: What do we do first, this is all new to me I have never attended a Town Council meeting, so I don't know what is expected of me.

Mr. Brandgard: I think you are making some request of the Town, and we need to hear from you what that request is.

Ms. Harvey: I am the co-founder of Angels and Doves Anti Bullying Program, and I am also the owner of Live Music Indiana, I have been in the music business thirteen years now and I have worked with national bands, and with my charity we are trying to save children from committing suicide due to bullying. So I go out and I speak to schools and I talk to all age groups, so far I have just been speaking in the State of Indiana, however I have been asked to speak in California, Wisconsin, and several States on the east coast as well. Our charity has been endorsed by the Ellen DeGeneres Show because they saw that I actually put a billboard up a year ago in Greensburg, Indiana after Billy Lucas took his life and when I put the billboard up, it made the National Wire and Ellen DeGeneres was one of the people that saw the billboards and commended us for doing what we were doing to try and save children's lives. So as a result of that, I took my charity and the music and partnered them together and decided to have a charity event called the Angel Ride and it is going to be a motorcycle charity ride from six States, including Indiana, it will be an all day music festival with two national bands and four local or regional bands. It is a really good way to raise money for the charity, but also to bring a lot of awareness to this horrible thing that is happening in our schools. I don't know if you are aware, but we just lost another little ten year old little girl last week in Illinois and ironically I was at a school speaking to 870 kids two days after this little girl committed suicide and the schools were only several miles apart from each other. The event, when I started calling people to let them know about the event, when I called the Harley Davidson dealership in Plainfield they asked me to come and speak to them in greater detail about the event, and they graciously donated their land, they have all that land that they own which is amazing, and they offered to donate it to my cause, and it would be perfect, we feel that with the land that is available and the event that we may even be able to draw 10,000 people which is a tremendous success. Live Nation and Verizon Wireless Music Center, they will pull in 24,000 people on a good night, so if this event were to draw 10,000 people, it would be a very successful event as well as, since I booked other music events before, I know that it would bring a great deal of revenue into Plainfield and as well, we would love for everyone to spend the night here in Plainfield the night of the event, the people that are coming in not only from Indianapolis, but from the other six States, so I have had a meeting with Becky Harris and with Carri Webber, I have talked to the Fire Department, I have had a meeting with all of the Hotels that encompass that small terrific little area back there where Harley is, even the restaurants came to the meeting, and so far it appears that I have the blessing of everybody back in that cult de sac area. I have even called Duke Realty and Fastenal and Primo and some of the other sites that are back there to get their blessing on it as well, and I have gotten all of that in writing, and the hotels are trying to be very gracious about their parking spaces by saying that possibly the spaces that are left over that are not going to be utilized by overnight guests, they might be able to sell the spaces for a certain amount of money the day of the event so that they are still making some money on the event and not turning people away, as well as I did speak to the owner of the hotel, I believe it is the Hampton Inn who owns that ten acre plot behind the hotel and he has also graciously offered his land for parking too, so we feel that we've got more than enough parking to accommodate 10,000 people, especially if at least two or more people come in a vehicle together as well as the Harley riders that might come in from other states, two motorcycles will fit into every parking space at a hotel if in fact they chose to spend the night. So I am here tonight to ask you if you would consider allowing Angels and Doves/Music Indiana and the Town of Plainfield to hold this event on Saturday May 12th, sorry I should have said that in the beginning, from 2:00 in the afternoon until 11:00 at night, the first band would take stage at 3:00 in the afternoon and the headliners would take the stage at 8:00 and the show would conclude exactly at 11:00 that evening. We've worked out all of the details for the staging, I worked with Indy Pro Audio out of Indianapolis, I've worked with them all thirteen years that I have been in the music business and the staging would go on the flat area of the parking area that is located at Harley. I did send in a plot layout to you two months ago, I hope that you have it, if not I can always fax it or mail it to you again, but I think we have all of the details worked out as far as the layout, as far as what the event would entail for the day, I believe that one of the major networks out of Indianapolis would be here to be a sponsor of the event you would get a lot of TV coverage, there would be a lot of newspaper coverage as well as there would be color posters at all 45 Harley Davidson dealerships in six States promoting the event and bringing riders into the event to possibly spend the night on Friday night and hopefully spending the night on that Saturday night.

Mr. Brandgard: It is a good cause and a good event. I think my concern is it seems like a small area for up to 10,000 people let alone the parking issues. I think as you said you've been working with Police Department here also and I think with Rich.

Ms. Harvey: People will come and people will go during the day as with any type of event. Some people will be at the track that day, it is opening day at the track, which I think is a good thing because I think that people that are there would maybe come after 6:00 for the National Dance, but the people that are more family oriented, I believe from experience will be there during the daylight hours, the daytime hours and they will be there more to do milling and buying, there will be clothing vendors, jewelry vendors, food and beverage, so I think the 10,000 obviously they are not all going to be there all at one time, and quite frankly if 10,000 people come to this event, it is a gift from God because if we have that kind of success in a first time event, I think would be amazing personally.

Mr. Brandgard: I think, I will let the other Council members speak, but I think you need to work very close with the Police and Fire Department, and also the Town Manager, but we need to understand if you have agreements, we have to see those agreements. We don't want to have something happen out there where the Town is going to get left holding the bag with a lot of expenses, trying to fix things that didn't go properly, so we have to be sure that we do have a plan that a compasses everything and it is a firm plan.

Ms. Harvey: That is terrific, but what kind of agreements or who would you like for me to get agreements with so that I can present those to you?

Mr. Brandgard: I think at a minimum if you have talked to the hotels on the parking and whoever you've talked to about parking, I think is at a minimum and also Harley Davidson.

Ms. Harvey: I can certainly do that, is there anything else, and is there anybody else that you would want me to speak with?

Mr. Carlucci: Mr. Brandgard, I think we have Chief Mitny and Captain Webber here tonight and I think they would like to also talk on this issue to the Council.

Ms. Whicker: Can I just confirm the date, you had mentioned May 12th, and opening day of the track, but in your previous paperwork I see May 5th, Cinco de Mayo, did the date change?

Ms. Harvey: Yes, it changed about two months ago and I did send out a notice I apologize of the confusion.

Ms. Whicker: That's ok, so it is the 12th not the 5th?

Ms. Harvey: Yes.

Ms. Whicker: Thank you.

Mr. Mitny: Captain Webber has had most contact with the representative here from Angels and Doves, Ms. Harvey. At our first meeting I was with them when they were speaking about the concept and what they wanted to do, as we've progressed here and she has indicated in her email to Joe that she does have some agreements, I don't know if they are verbal or written, but our big concern is parking, when she talks about parking in grass areas we have no idea what the weather is going to be like that day, so if we have rain before those areas aren't suitable for parking. We got to worry about egress and ingress; we've got to worry about sanitation as far as portalets and things like that, it is a good idea, it is a good cause, your concerns are the same as ours, it is kind of a small area, I know she thinks we will have people flowing all day but if she does get a good headliner band in there in the evening, then it is going to bring a good crowd, it isn't going to add to the flow, they are going to stay, especially when the pay the money to be there, they are not going to leave. So there are a lot of issues here that we need to work out. The Fire Chief is back there, Byron and I have talked a little bit, we have got EMS issues there again ingress and egress for fire apparatus if we had an issue at one of the buildings back there, I think if we work at it, I think we can probably get it worked out, but there is going to be a lot of agreements that

Ms. Webber: I know that Kim had discussed the selling of tickets, is that going to be sold prior too the event? They are going to be sold prior too, so we would we have an estimated number at that point and then we could do a cut off too?

Mr. Mitny: Looking at your email here, the Captain and I were talking out there, it said you've talked to Duke and Fastenal, are those verbal agreements you have?

Ms. Harvey: (inaudible, not in mic) I can tell you what I have so far is emails.

Ms. Webber: And Primo, they are not going to have an event an event that day, they are leaving it open for you?

Ms. Harvey: (inaudible, not in mic)

Ms. Webber: I would confirm with Primo because a lot of times, you are doing well in planning ahead, but I can see Primo planning something that day and then you not have that parking and then that will be essential to that parking if we could get it.

Mr. Mitny: You got Duke down here I don't know which Duke property you were talking about, I don't know if it is occupied now or if it is vacant, but if it is vacant now and they rent it between now and then, then you will lose that parking, so you are going to have to have contingencies.

Ms. Harvey: He mentioned the Portalets and sanitation and things of that nature, I have that all arranged, even handicap stalls, and sinks. They tell me I have to have so many per people, so that is just by code and then as far as trash and sanitation Harley Davidson has taken that responsibility upon themselves that they and myself will have people there working and empting all the trash containers throughout the day, we have a designated area behind the Harley where all of the trash will go, and then they know which day their trash pick up comes and so we will take care of that as well.

Mr. Brandgard: What is your drop dead date, when do you have to have approval?

Ms. Harvey: Well I was hoping by Thanksgiving, and I will tell you why. It is kind of which came first the chicken or the egg, I have a National Band right now that is if they came we would definitely have 10,000 people, they are waiting for me to have my meeting with you, so again it's like somebody is waiting for the next person to make the next move, once I get the ok from you, I can go out hopefully and shop the band and get my sponsors and get the band lined up. The band is the biggest concern for me because their deposit has to be paid and the deposit is 50% of their fee, which is very very high, so once I get approval from Plainfield then I can start selling my sponsorships and I can get the band approved, then we are ready to go once the band is in place.

Mr. Brandgard: Any comments?

Mr. Kirchoff: Great idea, I just have a concern about the location, I don't recall how, I am looking at the miniature diagram which is very helpful, how many people do you think you can put in that Harley field?

Ms. Harvey: A lot, it is really big; it is very very long and narrow.

Mr. Kirchoff: A lot is a pretty indefinite number for me.

Ms. Harvey: Well when we looked at it, again by the acreage and the land we feel that we can put 10,000 people in the Harley space itself including their parking lot and the front area because again, not everybody will be in that long narrow field, there will be tents for shopping and an area in the front more for the kids and teenagers to go too, but the Harley people, I know Carri and I have looked, some other people have looked, Becky, we felt that 10,000 would definitely fit in the Harley land that they own.

Ms. Whicker: Where is that adjacent land that the owner you said might as well, I am just looking at the hand drawn diagram.

Ms. Harvey: My wonderful drawing.

Ms. Whicker: I know it is not to scale, but you said that there was some adjacent land as well that they were going to be letting you use.

Ms. Harvey: Well it is not adjacent, it is the Hampton that is inside that little area when you turn off of the major road, there is over 10 acres of vacant land behind I believe the Hampton Inn, and there is an equation for figuring how many cars per acre, so that is how I did my figuring, I believe I emailed that in, I thought I did to tell how many cars, I did the math and I believe we have more than enough parking. I think that is if we were allowed to turn the cult de sac area into a one way that day and just kept the cars going past Harley and back out and around and just keep it one way, that that would be a really good flow for that day with hopefully not too many mishaps.

Mr. Carlucci: I will add to this, our concern from the beginning is the safety issue, and that the Town of Plainfield is not fully burdened by the cost of this in that because we are still the responsible party for both the Police and Fire Departments and what they have to do out there. I don't know how to do this other than we ought to try to set a deadline that we start seeing these written agreements at a specific point and continue to move on and you go this far and you've got those done, you go this far, it seems that we have to have more certainty in what really is going to go on here, because let's say 5,000 people show up and they are scattered all over, then the businesses that are there do suffer from it and that is not helpful, because at the end of the day if this goes bad, you will be somewhere else and we will be trying to explain this if it didn't go through. That is our concern so I would be glad to sit down with Chief's both Police and Fire Departments and try to come out at benchmarks that we need to achieve as we go forward, they have to be met and at some point we will get to the point that we are going to say ok, we are about there, but we've got to benchmark this somehow.

Ms. Harvey: Well I can guarantee that I will definitely have everything in writing by one week from today, I will have it in your hands, so once I have everything in writing from everyone you can just let me know the next thing that you want, and I will get it done.

Mr. Kirchoff: Ms. Harvey you've gotten verbal or written agreements that all the restaurants and all of the hotels out there are willing to put 10,000 people in there for a day?

Ms. Harvey: I have, well I didn't say I have written agreements from everybody, I have written from quite a few, almost everybody from the hotels, talked to Cracker Barrel, I have Duke in writing, Fastenal in writing, I have a lot of them in writing, I'd say I am 75% of the way there, so what I will do is I've got all the emails saved into a distribution list, I will send out one distribution list email tell everybody what I need, ask for their blessing, something in writing because I need to show it to Town Council and give them a deadline of this Friday and hopefully I will have everything that you need.

Mr. Brandgard: I was going to suggest in order to give her something to work with we could give conditional approval this evening based on having everything into us for the next meeting.

Mr. Kirchoff: My only concern, have we defined what she needs?

Mr. Brandgard: It comes back to have we given the definition of what we need to make this work?

Ms. Webber: Yes, I think what Town Manager Carlucci said, the things the parking in writing, and I would not count on, I know we can put cars in the areas where there is grass, but I would not count those just because we don't know till that day what the weather is going to be like, because if the weather is bad we are not going to be putting the cars in that grass area. So I would count your areas like Primo's, and any of the other warehouses that are willing to let us use their areas if they will put in writing that we can use those areas and count those.

Ms. Harvey: Ok.

Mr. Daniel: I would be inclined Mr. President, when you send that email out to all of the parties, if you would copy Mr. Carlucci the Town Manager on that so that he can see what it is you are telling them that you are going to do there so we could be confident that they understand what exactly you are doing?

Ms. Harvey: Sure.

Mr. Brandgard: Like I said understand this is conditional approval and final approval won't be given until we have what we need to feel comfortable.

Ms. Harvey: Sure, I will handle it quickly.

Mr. Brandgard: Very good, thank you.

Ms. Harvey: Thank you very much, I appreciate it.

Mr. Brandgard: Is there anybody else in the audience that would like address us? There is not anybody coming forward, have the Town Manager's report.

TOWN MANAGER'S REPORT

Mr. Carlucci: The only report I have is I have no report tonight. I am trying to think something up, but it was a short week for a lot of people, so I do not have a report, although Mr. Livingood did say he could not make it tonight, because he had a Homeowners meeting and to go on without him anyways.

Mr. Brandgard: I noticed he was missing.

STAFF REPORTS

Mr. Brandgard: We will go to staff reports, Chief Anderson? Chief Mitny?

Mr. Mitny: Long day, I apologize for not getting my report in to Bill so he could send it to you, but I just wanted to remind the Council that this month, well we are not in December yet, it is still November, but in December we are accreditation, we have received our assigned accreditation team, they will be arriving on December 10th and Lt. Lees as you know is our Accreditation Manager and she has been corresponding with the team and is going to send off the initial request to our documentation. Everything is going along smoothly and as I said they will arrive on Saturday the 10th and start their work and then depart on the 13th, just wanted to catch you up to speed.

Mr. Brandgard: I'm glad you are going through it, I have no qualms about the outcome, and it is a tough procedure.

Mr. Mitny: Yes it is.

Mr. Brandgard: Joe do you have anything from Planning? Clay do you have anything from Parks and Recreation? Jason do you have anything from Public Works? Ron do you have anything from HR?

Mr. Lydick: Thank you Mr. President seems like every time I come up here I talk about insurance, we had another insurance policy that is up for renewal and it is our short and long term disability insurance policy, plus a $20,000.00 term life insurance policy. The Security Mutual currently has our short term disability and our rate is .19 cents per $10.00 worth of benefits, and in 2012 they want to raise that to .35 cents per $10.00, for 84.2% increase, and we thought our health insurance increase was bad. The insurance quotes for 2012 from Security Mutual, .35 cents for the $10.00 benefit and .19 cents for the last year. We also received quotes from 9 different, well we sent out quotes from 9 different companies. Five of them declined to quote, they said one of the reasons was that we have too many Fire Fighters and Police Officers on our census so they would not quote and one other one said they just don't quote on Cities and Towns. So we did get 4 quotes back…

Mr. Brandgard: I understand the second one but that first one, does that mean that we have too many Fire Fighters and too many Police Officers?

Mr. Lydick: No, as a percentage of the total population, total employees. Lincoln Financial came back with a .25 cent per $10.00 benefit, that is 28.6% less than the quote from Security Mutual, but it is also a 31.6% more than what it was last year, so even with Lincoln Financial it is going to go up, it just is not going to go up as much. On the long term disability with Security Mutual, the current rates is .26 cents per $100.00 and the proposed is .30 cents per hundred, but Lincoln Financial came back of a quote of .23 cents per hundred, which is down .04 cents, which is 11.5% decrease or it is 23.3% less than the proposed rate, so you can see the short term is going up, and the long term is going down. We do currently have three people on the long term disability insurance, but they will continue to be on Security Mutual's, they do not go to the new company. Then the $20,000.00 term life insurance through Security Mutual the rate is .13 cents per thousand, the accidental death and dismemberment is .04 cents per thousand. With Lincoln Financial in order to come in lower they came in with .12 cents per thousand, and with the accidental death and dismemberment, .03 cents per thousand. Those are the rates, so what is the bottom line? What is the difference, well if you take into consideration the population we have, the amount of insurance we covered, if we were to switch from Security Mutual to Lincoln Financial the overall rate increase would be about 6.5% and that amounts to about $2,500.00 more than what it was last year. So what I need to know is, does Lincoln Financial of all of these four quotes that is the one that was the best quote and then of course Security Mutual is what we have now, so do you want to continue with Security Mutual or move to Lincoln Financial?

Mr. Brandgard: Lincoln Financial would provide the same services?

Mr. Lydick: Yes, whenever we send out for quotes, we send the policies with the quotes and they are quote based upon what our current policy says.

Ms. Whicker: Is this a rate that they would hold for six months, twelve months?

Mr. Lydick: The short term is a 1 year rate and the long term rate is a 2 year rate, so it is guaranteed, the long term allowed increase for 2 years, but the short term could go up a year from now.

Mr. Kirchoff: Do you have a sense of why that jumps, or is it based on our history or is it something else?

Mr. Lydick: Yes, we have had several claims on the short and long term disability, to have three people on long term is a little unusual and then I did not count the number of claims that we've had but we have had several. The short term disability runs for 22 weeks and there have been very few people that have gone, and then the 3 people are on the long term disability, but they can be anywhere from 3 weeks to 3 months generally. A typical claim, the claims are 60% of their salary and one claim takes almost all of our premium. Our premium runs about $1,800.00 a month for the short term disability, and a claim could run $1,100.00 to $1,400.00 a month.

Mr. Kirchoff: With that being said, I think we need to move to Lincoln Financial, will that take a motion?

Mr. Brandgard: Yes.

Mr. Kirchoff: I would move that we move our short term disability and long term disability and our term life insurance policies from Security Mutual to Lincoln Financial.

Mr. Lydick: Well I guess we don't have to do it for two years, we can just do it for one year but if we continue with Lincoln Financial, the long term rate will not go up.

Mr. Kirchoff: I'd just say we do it for a year then and confer it calendar year 2012.

Mr. Lydick: Actually it would be from December 1, 2011 till December 1, 2012.

Mr. Kirchoff: Ok, we are pretty close aren't we?

Mr. Lydick: Lincoln Financial said that it is not a problem, the only thing that they will want is the Clerk Treasurer to write them a check on December 1st for the estimated amount of premium and then that will bind it.

Ms. Whicker: I second the motion.

Mr. Brandgard: We have a motion that is second to move our long term and short term insurance and term life insurance from Security Mutual to Lincoln Financial for the next year. If there is no further discussion all those in favor signify by aye, opposed, motion carried.

Mr. Kirchoff: Ron I have one question, on our term insurance, can you give me a sense of are all of our full time employees are covered and it is only while they are under employment, I probably should know this, but I don't.

Mr. Lydick: The fact that Lincoln Financial is actually going to do a little bit better, we currently have three different classes of people, there are the ones the full time employees and they have the $20,000.00 term and the $20,000.00 accidental death and dismemberment, then we have the retirees prior to 2004 get $5,000.00 of term life insurance and no accidental death and dismemberment, and those that have retired since 2004, get a $10,000.00 life insurance policy for the same rate and no accidental death and dismemberment. But Lincoln Financial is going to let everybody have $20,000.00, so even the people that have retired ten years ago can get $20,000.00 worth of term life insurance for .12 cents per thousand.

Mr. Brandgard: At their cost.

Mr. Lydick: At their full cost.

Mr. Kirchoff: At the employees cost.

Mr. Carlucci: Yes I have, I got it a couple of days ago.

Mr. Kirchoff: The next meeting we will want to before you a proposed resolution similar to what you authorized Rich to vote on last week.
